This seminar looks at the variety of entities through which tribal nations engage in economic activities and the standards that govern whether such entities have sovereign immunity from suit. Tribal nations engage in economic development activities through corporations formed pursuant to tribal, state, and federal law. They sometimes form instrumentalities that they wholly own, but do not fully control. What standards govern whether these various entities enjoy sovereign immunity from suit?
