In December 2014, Indian Country was surprised by a Department of Justice guidance memo to U.S. District Attorneys regarding enforcement of federal marijuana laws in Indian Country. The memo provided each District with the discretion to decline to enforce those laws in Indian Country provided several parameters were met. On January 4, 2018, U.S. Attorney General Jeff Sessions issues a memo directing all U.S. Attorney's to enforce laws enacted by Congress, including marijuana laws. This session will discuss the recent changes, its impact on tribes considering legalizing marijuana and Congressional activity in response.
